I have substantial experience in all legal matters regarding Probate.
If you have been appointed as Executor under a Will relating to a deceased estate, it may be your responsibility to gain access to the deceased's property, file tax returns, arrange payment of debts, distribute net assets to beneficiaries and similar activities. In many cases, these tasks can only be accomplished after the Executor has obtained a Grant of Probate permitting the Executor to proceed.
If a person dies without a Will, the Probate Court can grant Letters of Administration, appointing an Administrator to the estate.
Administrators and Executors are trustees with similar responsibilities and they are the personal legal representative of the deceased Estate. If a will does not exist and there are no named beneficiaries, Administrators are entrusted to distribute an Estate's net assets to persons in accordance with inheritance laws. Administrators and Executors are answerable to the Probate Court, and may be required to lodge verified accounts with the Court.
